Normally, a project like this would fall under City of Oakland procedures and it still does.  However the review by the City of Oakland is only ministerial and is guided by state rules.  This housing development was submitted subject to state rules.  


Since the last update we have received notice that two tribes have an interest.  We have contacted the State of California to provide information from  CHRIS .  CHRIS stands for the California Historical Resource Information System.  Once this portion is completed we have 6 months to complete the plans for submission.

The CHRIS report has come back from the State and is now submitted to the City of Oakland.

At 5295 College Avenue, we are committed to sustainability and environmentally responsible practices. Our sustainable developments offer a range of features and amenities designed to minimize our environmental impact and promote a healthier, more sustainable future.


Currently we are looking at Mass Timber Construction.  Mass timber buildings are constructed with large pre-manufactured, multilayered, solid wood panels resulting in solid timber floors and walls typically ranging from 5 to 12 inches in thickness.  The cost of construction using Mass Timber construction is about 1/2 of steel and framing and concrete floors.

Rockridge Tower: How Many Units and Ownership Options?


Rockridge Tower will offer 88 residential units designed for ownership!  We're committed to providing a diverse range of opportunities, including:


  • Affordable Options:
    • 11 units:  Low-income (50% to 80% of Area Median Income - AMI) through an agreement with the City of Oakland.
    • 7 units:  Moderate-income (80% to 120% of AMI).
    • These units will have deed restrictions to ensure affordability for future owners.
    • The AMI for this neighborhood is $202,000+ annually.
  • Market-Rate Opportunities:  The remaining 70 units will be available for purchase at market rate at a future date.

Rockridge Tower: Unveiling the Vibrant Mix of Uses

  • Residential - the project will over both Below Market Rate opportunities and Market Rate Opportunities.  We are currently interviewing developers of these types of properties. 
  • Multiple full service restaurants on the ground floor and possibly a roof top full service restaurant with a large outdoor patio.
  • Retail Therapy: Multiple retail locations facing College Avenue and on floors 2 through 5 will provide convenient shopping options and add to the street's energy.  Imagine grabbing a coffee or browsing local stores right downstairs!
  • Office Space with a spectacular view will be included in the project.
  • Sustainable Options: Ample parking for bike storage and close proximity to BART  will encourage eco-friendly transportation choices.
  • Parking:  Rockridge tower will provide 110 parking spaces

The current configuration is GROSS S.F. OF CONSTRUCTION: 251,055 S.F.

GROSS FLOOR AREA: 174,795 S.F.  RESIDENTIAL GROSS FLOOR AREA: 116,440 S.F. There are 50 2 bedroom units and 38 3 bedroom units.


Construction will start within 2.5  years of the final approval of this project.  The estimated construction time is 1.5 years.


 SB 330, the Housing Crisis Act of 2019, is a California law designed to streamline the approval process for certain housing development projects. It allows developers to submit a Vesting Preliminary Application to lock in zoning, design, subdivision, and fee requirements at the time of application.

In this case, SB 330 does apply! The project seeking to construct a 15-story tower at 5295 College Avenue in Oakland, CA 94618 utilizes state rights established under SB 423, which can be combined with SB 330.

Here's how it works:

  • To take advantage of SB 423 streamlining benefits, a Vesting Preliminary Application under SB 330 is required.
  • The SB 330 application was submitted to the City along with preliminary plans for SB 35 and SB 423.
  • This ensures the project's zoning, design, subdivision, and fee requirements are "vested" based on current regulations, providing more certainty throughout the SB 423 approval process.

In simpler terms, SB 330 helps secure the project's development rights based on current city regulations while the SB 35 and the SB423 application are reviewed.


 

SB 423 allows for streamlined approval of certain multi-family housing projects in urban areas that meet specific criteria. These projects bypass the usual conditional use permit process if they:

  • Have 2 or more residential units.
  • Are located in a designated urban area.
  • Are zoned residential or mixed-use.
  • Have at least 2/3 of the space designated for residential use.

This aims to expedite construction of new housing units.


Yes, SB 423 applies here.  There are more than 2 units - 88 to be exact.  We are located in a designated urban area with the proximity to BART.  The property is zoned mixed use.  Two-thirds of the project is residential as defined by SB423.


 

Rockridge Tower: Building Height and SB 423

A common question is whether the City of Oakland typically allows buildings as tall as Rockridge Tower (15 stories) on College Avenue.


  • Current Zoning:  Ordinarily, the height limit on College Avenue is 55 feet.  his was just updated at the end of  August 2024.


So, how is this project moving forward?


  • California State Senate Bill 423 (SB 423):  This law allows for streamlined approval of certain multi-family housing projects that meet specific criteria, including addressing housing needs for lower-income residents.
  • Oakland's Housing Shortage:  The City of Oakland has been identified as not meeting its state-mandated housing goals, particularly for lower-income residents.
  • SB 423 as a Solution:  Because of this shortage, SB 423 can be used to override local zoning restrictions for projects that contribute to fulfilling these housing needs.


Rockridge Tower aims to be part of the solution by offering a mix of below-market rate and market-rate units.

No, this project is CEQA exempt.   This residential project is exempt from the California Environmental Quality Act (CEQA) review process. This exemption, granted by the State of California, streamlines the development process and helps expedite the delivery of much-needed housing to the market.

This project is submitted under SB330, SB 35, SB423 and the Housing Density Bonus Laws.  The process for review is streamlined and ministerial by state law.  Only objective standards are allowed to be applied to the project.  The City of Oakland will NOT be providing any public meetings on this project.

The project proposal was submitted to the City of Oakland on June 27, 2024.  While no public meetings are currently scheduled, we anticipate holding meeting after we receive zoning approval from the City of Oakland.  The planner from the City of Oakland on this project has agreed to participate in this meeting as well.

Unfortunately, the daycare's proposed sound mitigation measures are insufficient to maintain the peaceful atmosphere our tenants have relied on for decades. When the daycare project was submitted, we informed the community that changes to our business model might be necessary to ensure the continued viability of our property.  These plans represent the necessary changes to solve for the problem of unmitigated sound coming from the Child Day Care.
